The Gibraltar Betting and Gaming Association, which continues to be engaged in a dispute with the UK tax body regarding the UK’s point-of-consumption tax regime, was dealt a blow by the Court of Justice of the European Union yesterday.

CJEU blow for Gibraltar in POC case

The CJEU advocate general Maciej Szpunar said that the tax regime was not in contravention of the rules of the Treaty of the Functioning of the European Union, specifically Article 56.

The GBGA claims that the tax violates Article 56 by introducing restrictions that could limit the free movement of goods and services within EU borders.

However, Szpunar said that as a single member state, the tax dispute between the UK and Gibraltar was an internal affair and Article 56 could not be cited as an authority for an action.

Following the news, the GBGA issued a statement saying it is disappointed with the opnion, stating that it will now wait for a ruling from the CJEU.
